enroll in a subscription, contact us, join a marketing list, enter a
promotion, complete a survey, or submit a review.

subscription platforms, fulfillment partners, shipping carriers,
analytics providers, customer-support tools, review platforms, and
email or SMS providers.
- Advertising, marketing, and business partners, including platforms
that help us measure advertisements, understand campaign
performance, or present relevant advertisements.

platforms when you interact with our account, tag Kith&Oak, or make

To process payments; accept and fulfill orders; manage accounts and
subscriptions; arrange shipping and delivery; provide order and
subscription notices; process cancellations, returns, replacements, and

Security and fraud prevention
To authenticate accounts, process payments securely, detect and prevent
fraud, abuse, unauthorized transactions, security incidents, or other
illegal or harmful activity, and protect Kith&Oak, our customers, and

To comply with applicable law, tax and accounting requirements, court
orders, subpoenas, and lawful government requests; establish, exercise,
or defend legal claims; enforce our policies; conduct audits; complete
corporate transactions; and protect our rights, property, personnel,

With your consent
For another purpose disclosed to you when we request your consent.
Where applicable law requires a legal basis for processing, we may rely
on performance of a contract, compliance with a legal obligation, our
legitimate business interests, protection of vital interests, or your
consent, depending on the circumstances.
4. COOKIES AND SIMILAR TECHNOLOGIES
We and our service providers use cookies and similar technologies to
operate the Services, remember preferences, maintain shopping carts,
keep accounts secure, understand website performance, measure marketing,
and personalize content or advertising.
Cookies may be:
- Necessary cookies, which support checkout, account access, security,
fraud prevention, and core website functions.
- Functional cookies, which remember settings and preferences.
- Analytics cookies, which help us understand traffic and use of the
Services.
- Advertising cookies, which help measure campaigns and present
advertisements based on activity across websites or services.
You can control certain cookies through the cookie or privacy settings
presented on our website, where available, and through your browser
settings. Blocking cookies may affect checkout, account features, saved
preferences, or other parts of the Services.
Where required by law, we will request consent before using
non-essential cookies. If your browser sends a legally recognized
opt-out preference signal, such as Global Privacy Control, we will
process it as required by applicable law for the browser and device
sending the signal.
Except for legally recognized opt-out preference signals, we may not
respond to “Do Not Track” settings because there is no single industry
standard for those signals.
5. MARKETING COMMUNICATIONS
Email
You may unsubscribe from promotional emails at any time by selecting the
unsubscribe link in the message. Even after opting out of marketing
emails, we may continue sending non-promotional communications relating
to orders, subscriptions, security, policy changes, or customer-service
requests.
Text messages
If you opt in to SMS or MMS messages, we may use your telephone number
and interaction history to send transactional or promotional messages in
accordance with your consent. Message frequency may vary, and message
and data rates may apply.
You may opt out of marketing text messages by replying STOP. You may
receive a final confirmation message. Opting out of marketing texts does
not prevent us from sending messages that are necessary to complete a
transaction or respond to your request where legally permitted.
Consent to receive marketing messages is not a condition of purchase.
6. AUTOMATION AND AI-ASSISTED FEATURES
We may use automated or artificial-intelligence-enabled tools to assist
with customer support, message generation, recommendations, fraud
prevention, marketing personalization, or analysis of customer
interactions.
When you communicate through a feature supported by these tools, the
content of your message and relevant information such as order history,
website activity, or product interests may be processed to generate or
improve the response, personalize the experience, evaluate quality, and
maintain safety.
Automated responses may contain mistakes. You may request human
assistance by contacting hello@kithnoak.com. We do not use automated
decision-making to make decisions that produce legal or similarly
significant effects about you unless we provide any notice and choices
required by applicable law.
7. HOW WE DISCLOSE PERSONAL INFORMATION
We may disclose personal information for legitimate business purposes
to:
- Shopify, which hosts our store, supports checkout, processes store
and customer data, provides analytics and security features, and
enables other commerce functions.
- Payment processors and financial providers, which process and verify
transactions and help prevent fraud.

prepare, ship, track, and deliver orders.

recurring orders, payment retries, customer accounts, and
subscription changes or cancellations.

storage, cybersecurity, fraud-prevention, IT, and website-service
providers.
- Analytics and advertising partners, which help us understand website
activity, measure marketing performance, create audiences, and
display advertisements.
- Email, SMS, customer-support, survey, and review providers, which
help us communicate with customers and collect or publish customer
feedback.
- Professional advisers, such as accountants, auditors, insurers,
consultants, and attorneys.
- Government authorities or other parties for legal reasons, when we
believe disclosure is required by law, necessary to respond to valid
legal process, or appropriate to prevent harm, fraud, or illegal
activity.
- A purchaser, investor, successor, or other participant in a business
transaction, such as a merger, financing, reorganization,
bankruptcy, or sale of some or all of our assets.
- Other parties at your direction or with your consent, such as social
networks or third-party integrations you choose to use.
Service providers may use personal information only as permitted by
their agreements with us and applicable law. Third parties acting
independently may process information under their own privacy policies.
8. SHOPIFY’S ROLE
Shopify collects and processes personal information relating to your
access to and use of the Services to host, secure, provide, personalize,
and improve Shopify-powered commerce services.
Information submitted through the Services is transmitted to Shopify and
may be shared with Shopify affiliates and service providers located in
countries other than your country of residence. Certain enhanced Shopify
features may use information about your interactions with our store,
other merchants, and Shopify.

9. SALE, SHARING, AND TARGETED ADVERTISING
We do not sell personal information for money. However, some privacy
laws define “sale,” “sharing,” or “targeted advertising” broadly. Our
use of advertising cookies, pixels, and similar technologies may involve
disclosing identifiers, device information, website activity, and
inferences to advertising or marketing partners in a way considered a
sale, sharing, or targeted advertising under those laws.
Where applicable, you may opt out through a “Your Privacy Choices” or
“Do Not Sell or Share My Personal Information” link displayed on our
website, through available cookie settings, by sending a recognized
Global Privacy Control signal, or by contacting hello@kithnoak.com.
We do not knowingly sell or share the personal information of
individuals under 16 years of age.
10. THIRD-PARTY WEBSITES AND SOCIAL MEDIA
The Services may link to websites, social-media platforms, or online
services operated by third parties. We do not control and are not
responsible for their security, accuracy, or privacy practices. Review
the third party’s privacy policy before providing information.
Information posted in public or semi-public areas, including reviews and
social-media posts, may be visible and used by other people. A link to a
third-party service does not, by itself, mean that Kith&Oak endorses
that service.
11. CHILDREN’S PRIVACY
The Services are intended for adults and are not directed to children
under 16. We do not knowingly collect personal information from children
under 13.
If you are a parent or guardian and believe that a child has provided
personal information to us, contact hello@kithnoak.com. We will
investigate and take appropriate steps to delete the information as
required by law.
12. DATA SECURITY
We use reasonable administrative, technical, and physical safeguards
designed to protect personal information. However, no security measure,
website, database, or transmission method is completely secure, and we
cannot guarantee absolute security.
Do not send sensitive or confidential information through unsecured
channels. You are responsible for maintaining the confidentiality of
your account credentials and for notifying us if you suspect
unauthorized account access.
13. DATA RETENTION
We retain personal information for as long as reasonably necessary for
the purposes described in this Privacy Policy, including to:
- provide the Services and maintain accounts or subscriptions;
- fulfill orders and respond to customer-service requests;
- maintain business, tax, accounting, and transaction records;
- comply with legal and regulatory obligations;
- resolve disputes, prevent fraud, and enforce agreements; and
- preserve information subject to a legal hold or required for legal
claims.
The applicable retention period depends on the type of information, the
nature of our relationship with you, the sensitivity of the information,
legal requirements, and whether the purpose can be achieved through
de-identification. When information is no longer reasonably necessary,
we may delete, anonymize, or securely dispose of it.
14. YOUR PRIVACY RIGHTS AND CHOICES
Depending on where you reside and subject to legal exceptions, you may
have the right to:
- request access to or confirmation of the personal information we
process about you;
- request the categories or specific pieces of personal information we
have collected;
- request correction of inaccurate personal information;
- request deletion of personal information;
- obtain a portable copy of certain personal information;
- opt out of the sale or sharing of personal information;
- opt out of targeted advertising or certain profiling;
- limit certain uses or disclosures of sensitive personal information;
- withdraw consent where processing is based on consent;
- appeal our decision concerning a privacy request; and
- receive equal service and pricing without unlawful discrimination
for exercising a privacy right.
These rights are not absolute and may not apply to every person or in
every circumstance. For example, we may retain information needed to
complete a transaction, comply with law, prevent fraud, exercise legal
rights, or fulfill another permitted purpose.
How to submit a request
To exercise an applicable privacy right, email hello@kithnoak.com with
the subject line “Privacy Request” and describe the right you wish to
exercise.
We may request information reasonably necessary to verify your identity,
such as details associated with your account or recent order. We will
use verification information only to process the request. If we cannot
verify your identity, we may be unable to fulfill certain requests.
You may use an authorized agent where permitted by law. We may require
proof that the agent is authorized to act for you and may ask you to
verify your identity directly.
We will respond within the period required by applicable law. If we deny
a request, you may have the right to appeal by replying to our decision
or emailing hello@kithnoak.com with the subject line “Privacy Appeal.”
15. INTERNATIONAL DATA TRANSFERS
We and our service providers may transfer, store, or process personal
information outside your state, province, or country, including in the
United States and other countries where data-protection laws may differ.
When required, transfers from the European Economic Area, United
Kingdom, or Switzerland will be supported by an approved legal
mechanism, such as an adequacy decision or applicable standard
contractual clauses, together with supplemental safeguards where
required.
16. COMPLAINTS
If you have a concern about our privacy practices, contact
hello@kithnoak.com. We will review and respond to the concern.
Depending on where you reside, you may have the right to appeal our
response or lodge a complaint with your state attorney general,
data-protection authority, or another competent regulator.
17. CHANGES TO THIS PRIVACY POLICY
We may update this Privacy Policy to reflect changes in our practices,
technology, Services, or legal obligations. We will post the revised
